DreamScape Software License & Terms of Use

1. Welcome to DreamScape

Thank you for using DreamScape.

DreamScape is a free, offline desktop application that allows users to create, customize, and chat with AI-powered characters. By downloading, installing, or using DreamScape, you agree to these Terms of Use.

If you do not agree with these Terms, you should not use DreamScape.

2. Eligibility

DreamScape is intended for adults only.

You must be 18 years of age or older to download, install, or use DreamScape.

By using DreamScape, you represent that you meet this requirement.

3. License

The DreamScape Project grants you a personal, non-exclusive, non-transferable license to use DreamScape free of charge.

This license allows you to:

• Install DreamScape on your own devices.
• Create and edit characters.
• Import and export character files.
• Create scenarios, greetings, personality profiles, memory logs, and chat histories.
• Use compatible AI models included with or supported by DreamScape.
• Share your exported character files with others.
• Voluntarily use optional DreamScape online features made available to you, subject to any additional rules that apply to those services.

This license does not transfer ownership of DreamScape or its source code to you.

4. About DreamScape

DreamScape is designed as a local-first application.

During normal local use:

• DreamScape does not require a DreamScape account.
• DreamScape does not automatically upload your conversations.
• DreamScape does not automatically upload your character files.
• DreamScape does not automatically upload your memory logs.
• DreamScape does not collect analytics or telemetry.
• Your locally stored creative data remains on your own device unless you choose to move, export, share, or submit it through an optional online feature.

DreamScape may provide optional online services, including update checks and the Shared Character Library. These services only transmit information necessary for the feature you choose to use. Additional rules may apply to content voluntarily submitted to an official DreamScape online service.

5. Your Content

Everything you create using DreamScape belongs to you or to the respective rights holder.

This includes, but is not limited to:

• Characters
• Scenarios
• Greetings
• Personality Profiles
• Memory Logs
• Chat Histories
• User prompts
• AI-generated conversations

You are solely responsible for any content you create, import, export, save, publish, or share using DreamScape.

5A. AI-Generated Content & User Permissions

DreamScape is a creative tool that assists users in generating original content. Depending on applicable law, certain AI-generated content may or may not qualify for copyright or other intellectual property protection.

Nothing in these Terms guarantees that any content created using DreamScape is eligible for copyright protection in any jurisdiction.

For purposes of DreamScape's official services and community rules, the person who lawfully creates and submits content is treated as its creator unless credible evidence indicates otherwise.

Unless the creator has expressly granted permission, other users may not:

• Copy or redistribute another user's exported or submitted DreamScape content.
• Reupload another user's content to websites, social media platforms, AI services, or similar platforms.
• Compile, republish, or monetize another user's generated content.
• Falsely claim authorship of another user's DreamScape creations.

These restrictions apply regardless of whether the content qualifies for copyright protection under applicable law and govern use of the Shared Character Library, official DreamScape communities, and other DreamScape-operated services.

This section does not limit any rights granted by applicable law.

6. Acceptable Use

You agree to use DreamScape responsibly and in accordance with all applicable laws.

You may not use DreamScape to:

• Violate any applicable law.
• Create or distribute illegal material.
• Infringe another person's copyright, trademark, or other legal rights.
• Distribute malware, viruses, or other harmful software.
• Impersonate another person for fraudulent purposes.
• Use DreamScape in connection with criminal activity.

Additional rules are described in the DreamScape Acceptable Use & Prohibited Content Policy.

7. User Responsibility

DreamScape is a creative tool.

The DreamScape Project cannot control how users choose to use the application.

You are responsible for:

• The prompts you enter.
• The content you create.
• The files you import.
• The files you export.
• Anything you choose to share, publish, or submit to an online service.

If you export, publish, or submit content created with DreamScape, you remain responsible for ensuring that doing so complies with applicable law and any additional rules that apply to the service where the content is submitted.

Content submitted to the DreamScape Shared Character Library is subject to the DreamScape Community Content & Creator Rights Policy, separate Shared Character Library Submission Guidelines, and moderation standards.

Users should only redistribute, repost, compile, or commercially exploit exported or submitted DreamScape content if they created it themselves, have the creator's permission, or otherwise have a valid legal right to do so.

The DreamScape Project expects users to respect the creative work of others even where applicable law may not provide exclusive intellectual property protection for AI-generated content.

8. Local Storage

DreamScape stores your data locally.

Because DreamScape does not operate cloud storage or user accounts, the DreamScape Project cannot recover lost data, restore deleted chats, or retrieve files stored on your device.

Users are encouraged to maintain their own backups.

9. Updates & Optional Online Features

The DreamScape Project may release updates, bug fixes, new features, UI improvements, additional AI model support, or other improvements.

Updates may be distributed through Google Drive, Discord, DreamScape-operated infrastructure, or other official DreamScape distribution channels.

DreamScape may perform an optional update check when enabled by you or when you manually request one. Update checks do not include your conversations, characters, scenarios, lorebooks, memory logs, prompts, or AI-generated responses.

DreamScape may also provide optional online features such as the Shared Character Library. Use of those features is voluntary and may be governed by additional published rules, moderation standards, and privacy disclosures.

You are responsible for downloading and installing updates if you wish to use newer versions of DreamScape.

10. No Warranty

DreamScape is provided "AS IS."

While every effort is made to provide a stable and enjoyable experience, DreamScape may contain bugs, errors, unexpected AI responses, compatibility issues, or other problems.

The DreamScape Project makes no guarantee that DreamScape will always operate without interruption or error.

Use DreamScape at your own risk.

11. Limitation of Liability

To the fullest extent permitted by law, the DreamScape Project shall not be liable for any indirect, incidental, or consequential damages arising from your use of DreamScape.

This includes, but is not limited to:

• Lost data.
• Corrupted files.
• AI-generated responses.
• User-created content.
• Imported character files.
• Exported character files.
• Damage resulting from misuse of the software.

Your use of DreamScape is entirely at your own risk.

12. Changes to DreamScape

DreamScape is an actively developed project.

Features, supported AI models, user interface elements, file formats, and functionality may change over time.

The DreamScape Project may modify, improve, replace, or discontinue features without prior notice.

13. Changes to These Terms

These Terms may be updated as DreamScape evolves.

The latest version will be made available alongside future DreamScape releases or through official DreamScape distribution channels.

Continued use of DreamScape after updated Terms are published constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by the laws of the State of Kansas and the applicable laws of the United States.
